Examples of Contracts with Limited or No MBE Participation
Sole Source
Sole source contracts are those that dictate that a single contractor supply goods
and services to the City. The reasons for sole sourcing are numerous and can be
attributed to some of the following:
• The scope of work being performed is unique in nature and there is only
one (sole) vendor or a limited number of vendors available to supply the
service (e.g.; purchase of natural gas).
• A single (sole) vendor is able to supply a service in a cost efficient and
timely manner (e.g.; signal system controllers).
• Manufactures have proprietary equipment that does not allow for sub-
contracting opportunities (e.g.; Vendor A uses specialized equipment
when inspecting water and sewer lines and there are no opportunities for
sub contractors to participate on the project).
Grants
A grant is the giving of funds for a specific purpose to a specific entity. No
subcontracting requirements are attached to grant monies.
Emergency Purchases
The City does set goals on emergency procurement projects because of state
procurement laws (e.g.; security guards to secure City agencies). However, the City
will occasionally ask contractors to voluntarily utilize minorities when minority
participation is obtainable.
Inter-governmental Agencies Agreements
The City of Richmond enters into contracts with other governmental agencies
(e.g.; Virginia Department of Transportation, Virginia Commonwealth University
and City agencies). Therefore, there are no opportunities for subcontractors to
participate.
