TERMINATION OF EMPLOYMENT


The decision to terminate an employee’s contract should be taken early and may be taken if an employee has breached a term in their contract of employment for example. You must remember that discrimination laws apply from day one; this includes direct and indirect discrimination, harassment and victimisation.


An employee with at least 51 weeks’ service has a right not to be ordinarily unfairly dismissed. There are six potentially fair grounds to dismiss an employee.


Our top tip is seek advice before you take any steps towards terminating an employee’s employment. Ideally you should seek this advice from an employment lawyer but you can also seek free preliminary advice from the Government’s advice service, ACAS, by looking at their website at www.acas.org or phoning their free helpline on 08457 474747.
