DOMAIN ABUSE

There is a huge industry in misusing other people’s domain names, often called “cybersquatting” and “typosquatting”, where unscrupulous businesses or individuals deliberately purchase names which are the same or similar as your own brand, with the hope of either diverting trade away from your own website, or forcing you to buy back the offending domain at outrageous and inflated prices. Each domain type has its own dispute resolution policy and procedure. The .uk dispute policy can currently be found at www.nominet.org.uk/disputes/drs/ and the .com (and others) can currently be found at www.wipo.int/amc/en/ domains/guide/index.html.

HIRING STAFF

Employment law is a fast paced and complex area of law which is frequently changing as new laws are introduced both by the UK Government and the European courts.

This can give rise to many potential pitfalls for ill prepared employers as well as costly and time consuming litigation.

The following will give you a few basic guiding principles to help you. However, it is not intended as an exhaustive list of do’s and don’ts.

Many aspects of the fashion industry are reliant on good personnel. Happy staff = happy business so read this guide carefully and remember, if in doubt seek legal advice before you do anything.

The stages:

• Recruitment and selection; • Terms and conditions; • Termination of employment.

RECRUITMENT AND SELECTION

Equality legislation requires that no one should be treated less favourably when applying for a job. As a potential employer you have a duty not to discriminate unlawfully against any potential candidate by your recruitment process. You can be sued by someone you have never met! For more information see advice on the Equality and Human Rights Commission website www.equalityhumanrights.com.
